Stream Deck Plugin EULA

This End User License Agreement (“EULA”) governs your use of the StreamChum Stream Deck plugin (the “Plugin”). It is a contract between you and the Maker only, not with Corsair Memory, Inc., Elgato, or their affiliates.
1. Parties
The Maker of the Plugin is the Operator of StreamChum, as identified in the StreamChum Privacy Policy.

Support is provided by email. The Maker does not currently offer a dedicated telephone support line. Postal correspondence may be sent to the Maker at the address in the Privacy Policy.
2. Acknowledgment
You and the Maker acknowledge that this EULA is concluded between you and the Maker only, and not with Corsair Memory, Inc. or Elgato. The Maker, not Corsair/Elgato, is solely responsible for the Plugin and its content.
3. Scope of license
Subject to this EULA, the Maker grants you a limited, non-exclusive, non-transferable license to use the Plugin on Corsair/Elgato Stream Deck products that you own or control, solely for your personal or internal business use with StreamChum.
You may not rent, lease, sell, redistribute, sublicense, reverse engineer (except where applicable law expressly permits), or use the Plugin to develop a competing product, except as allowed by law or open-source licenses that apply to bundled third-party components.
4. StreamChum account and API token
The Plugin requires a StreamChum account and a limited, revocable API token that you create in StreamChum. You authorize the Plugin to store the API address and token in Stream Deck plugin-wide settings on your device, and to send the token to your configured StreamChum API to list enabled Actions and run the Action assigned to a pressed key.
You are responsible for protecting the token, reviewing Actions before assigning them to keys, and revoking the token if the device or token is lost or shared. Use of StreamChum itself remains subject to the StreamChum Terms of Service and Privacy Policy.
5. Maintenance and support
The Maker is solely responsible for providing maintenance and support for the Plugin, as described on streamchum.com/support and by email at [email protected]. You acknowledge that Corsair/Elgato have no obligation to furnish any maintenance or support for the Plugin.
6. Warranty
To the maximum extent permitted by applicable law, the Plugin is provided “as is” and “as available.” The Maker disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not permitted by law.
If the Plugin fails to conform to any warranty that cannot lawfully be disclaimed or that the Maker expressly provides, and you purchased the Plugin, the Maker will refund the purchase price you paid for the Plugin. To the maximum extent permitted by applicable law, Corsair/Elgato have no other warranty obligation whatsoever with respect to the Plugin, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are the Maker’s sole responsibility.
If the Plugin is provided free of charge, the Maker’s sole obligation for a warranty failure that cannot lawfully be disclaimed is to attempt a reasonable fix or provide guidance for uninstalling or reinstalling the Plugin, except where applicable law requires a different remedy.
7. Product claims
You and the Maker acknowledge that the Maker, not Corsair/Elgato, is responsible for addressing any claims by you or any third party relating to the Plugin or your possession and/or use of the Plugin, including but not limited to: (i) product liability claims; (ii) any claim that the Plugin fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation. Nothing in this EULA limits the Maker’s liability to you beyond what is permitted by applicable law.
8. Intellectual property claims
In the event of any third-party claim that the Plugin or your possession and use of the Plugin infringes any third party’s intellectual property rights, the Maker, not Corsair/Elgato, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
9. Legal compliance
You represent and warrant that (i) you are not located in a region that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” region; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
You agree to use the Plugin only in compliance with applicable law, the StreamChum Terms of Service, and the terms of the Stream Deck / Marketplace platforms through which you obtained the Plugin.
10. Privacy
How StreamChum handles information related to the Plugin, API tokens, and Action runs is described in the StreamChum Privacy Policy.
11. Limitation of liability
To the maximum extent permitted by law, the Maker will not be liable for indirect, incidental, special, consequential, or punitive loss, or for lost profits, revenue, data, goodwill, broadcasts, or opportunities arising from the Plugin. The Maker’s total liability arising from the Plugin will not exceed the greater of the amount you paid for the Plugin or £100. These limits do not apply where liability cannot lawfully be limited.
12. Changes and termination
The Maker may update this EULA by publishing a revised version at this URL and updating the date above. Continued use of the Plugin after a change takes effect means you accept the revised EULA, except where applicable law requires a different process. The Maker may discontinue the Plugin or terminate this license if you breach this EULA or if continued distribution creates legal, security, or operational risk. You may stop using the Plugin at any time by uninstalling it and revoking any related StreamChum API token.
